Criminal Proceedings Against Citizen Accused of Disseminating Defamatory Information About an Investigator and Committing Hooliganism Referred to Court

The preliminary investigation carried out under the criminal proceedings initiated by the Anti-Corruption Committee of the Republic of Armenia, based on information received from the Investigation Committee, established that a citizen disseminated information damaging the rights and legitimate interests of an investigator in connection with the latter’s lawful official activities, and also committed hooliganism using information and communication technologies.

In particular, it was established that, in connection with a criminal proceeding investigated by a relevant investigator of the Investigation Committee and terminated by a decision dated May 31, 2024, the person, using information and communication technologies, published statements on his personal Facebook page in an open public format. While referring to the said criminal proceedings, the person used obscene language and insults directed at the investigator and his family members, thereby publicly degrading the honor and dignity of a public servant and demonstrating obvious disrespect toward society, as well as open contempt for moral and legal norms.

The citizen has been charged under Article 297, Part 2, Clause 3 and Article 490, Part 2 of the Criminal Code of the Republic of Armenia. Arrest has been applied as a measure of restriction.

The preliminary investigation under the criminal proceedings has been completed, and the materials of the proceedings, together with the indictment, have been referred to the competent court.

Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
