The damage caused to the community by the former head of Ghazaravan community, accused of illegal alienation of land and money laundering, has been restored

The criminal proceedings conducted by the RA Anti-Corruption Committee established that the person who held the position of head of the Ghazaravan community within the period from 2011 to 2021 organized and held formal auctions in 2018 in order to acquire agricultural land plots of 0.1333 ha, 0.3670 ha, 0.2887, and 9,750 sq m belonging to the community on affordable terms and to conceal their ownership.

In particular, the head of the community entered into an agreement with his friend and relative, who participated in the auctions and were recognized as the winners, to later rename the land plots acquired as a result of formal auctions. Then, on the instructions of the community head, false protocols were drawn up regarding the auctions that did not actually take place, on the basis of which the community head sold the land plots to the two aforementioned persons who were allegedly recognized as winners, withdrawing the real estate from the community property fund.

Then, the community head, wishing to hide the true nature and source of origin of the land plots acquired through criminal means and actually owned by him, alienated the land plots with areas of 0.3670 ha and 0.2887 square meters from them to various persons under purchase and sale agreements concluded about 20 days after they were acquired through a formal auction, and transferred the land plot with an area of ​​0.1333 ha to a member of his family under a formal purchase and sale agreement signed in 2022. Later, the land plot with an area of ​​9,750 square meters in 2019 In September, he divided it into five parts, four of which were transferred to his relatives through donation contracts, and the remaining large land plot was transferred to him through a formal sale and purchase contract, as a result of which the official actually acquired the opportunity to dispose of and use the aforementioned plots of land.

In addition, the preliminary investigation revealed that with the assistance of the community head, in 2006, 6,800 square meters and 35,000 square meters of land were also alienated through formal auctions by his father, who held the position of head of the same community at that period.

As a result, a total of 59,440 square meters of land were withdrawn from the community balance sheet and later transferred to the actual disposal of the father and son, of which the former head of the community expressed his willingness to return 43,257 square meters of land to the community as damage caused to the state, and paid their market values ​​to the state budget for the remaining land plots, AMD 10,520,000.

For the above-mentioned criminal acts, the former head of Ghazaravan community was charged under Article 308, Part 1 (2 episodes), Article 314, Part 1 (2 episodes), Article 190, Part 3, Clause 3, and Article 190, Part 1 of the former Criminal Code of the Republic of Armenia.

The preliminary investigation under his criminal proceedings has been completed. The materials of the proceedings, along with the indictment, were submitted to the supervising prosecutor with a motion to approve it and send it to court.

Notification. the person accused of a crime is considered innocent until his guilt is proven in accordance with the procedure established by the RA Criminal Procedure Code by a verdict entered into legal force.
